1. Introduction and Acceptance of Terms

Welcome to Arundel Holidays. These Terms and Conditions govern all bookings, reservations and travel services provided by Arundel Holidays to you. By making a booking or using any of our services, you confirm that you have read, understood and agree to be bound by these Terms.

These Terms form a legally binding contract between you and Arundel Holidays. If you are booking on behalf of a group, you accept these Terms on behalf of all members of your party and are responsible for ensuring that each member is aware of and agrees to them.

We reserve the right to update or amend these Terms at any time. The most current version will always be available on our website and will apply to all bookings made from the date of publication.

2. Eligibility and Booking Requirements

2.1 Age Requirements

To make a booking with Arundel Holidays, you must be at least 18 years of age. Travellers under the age of 18 must be accompanied by a parent or legal guardian. Some tours and excursions may have additional age restrictions, which will be clearly stated in the relevant tour description.

2.2 Booking Process

All bookings are subject to availability and confirmation by Arundel Holidays. A booking is confirmed only when:

  • You have completed and submitted the booking form with accurate personal and travel information
  • The required deposit or full payment has been received and processed
  • You have received a written booking confirmation from us

It is your responsibility to ensure that all personal information provided at the time of booking, including names, passport details and contact information, is accurate and complete. Any errors may result in additional charges or travel disruptions for which Arundel Holidays cannot be held liable.

2.3 Health and Fitness Requirements

Certain tours and activities may require a minimum level of physical fitness or have specific health requirements. These will be clearly communicated in the tour description. By booking, you confirm that you and all members of your group meet these requirements. We strongly recommend consulting your physician before booking if you have any pre-existing medical conditions.

3. Payments, Deposits and Pricing

3.1 Deposit

A non-refundable deposit is required at the time of booking to secure your reservation. The deposit amount varies depending on the tour package and will be clearly stated on your booking form. Payment of the deposit constitutes your acceptance of these Terms.

3.2 Final Payment

The balance of your tour cost must be paid no later than 60 days before the scheduled departure date, unless stated on your booking confirmation. Failure to pay the balance by the due date may result in cancellation of your booking, in which case our standard cancellation charges will apply.

3.3 Pricing

All prices quoted by Arundel Holidays are in Sri Lankan Rupees (LKR) or the currency specified at the time of quotation, and are per person unless stated. We reserve the right to adjust prices in the event of significant currency fluctuations, government-imposed taxes, fuel surcharges or other increases in operating costs.

3.4 Accepted Payment Methods

We accept payment by bank transfer, credit card, debit card and other methods as specified on our website. Any bank charges or transaction fees associated with your chosen payment method are your responsibility.

4. Cancellations, Modifications and Refunds

4.1 Cancellation by the Client

If you wish to cancel your booking, you must notify us in writing. The following cancellation charges apply, calculated as a percentage of the total tour cost:

  • More than 60 days before departure: Loss of deposit only
  • 30-60 days before departure: 30% of the total tour cost
  • 15-29 days before departure: 50% of total tour cost
  • 7-14 days before departure: 75% of the total tour cost
  • Less than 7 days before departure or no-show: 100% of the total tour cost

 

We strongly recommend that all clients obtain comprehensive travel insurance to protect against unforeseen cancellation costs.

 

4.2 Refund Processing Timeline

Where a refund is due in accordance with these Terms, Arundel Holidays will process it within the following timeframes from the date of written cancellation confirmation:

  • Credit card and debit card payments: Refunded within 14 business days
  • Bank transfers: Refunded within 21 business days
  • Cancellations by Arundel Holidays (Section 4.4): Refunded within 10 business days

Refunds will be issued to the original payment method used at the time of booking. Processing times may vary depending on your bank or card provider. Arundel Holidays is not responsible for any delays caused by financial institutions once a refund has been initiated. Any applicable bank charges or currency conversion fees are the client’s responsibility.

4.3 Amendments by the Client

We will do our best to accommodate any changes you wish to make to your booking. Amendment requests must be submitted in writing and are subject to availability and any applicable charges from third-party suppliers. An administration fee may apply for each amendment. We cannot guarantee that amendments requested within 30 days of departure can be accommodated.

4.4 Cancellation or Changes by Arundel Holidays

We reserve the right to cancel, alter or modify any tour due to circumstances beyond our control, including natural disasters, political instability, acts of terrorism, severe weather, government directives or insufficient bookings. In such cases:

  • If we cancel a tour before departure, we will offer you a full refund of all monies paid or a credit note applicable to a future booking or an alternative tour of comparable value.
  • If we make a significant change to your tour, we will notify you promptly and offer equivalent alternatives.

 

Arundel Holidays shall not be liable for any incidental expenses you may have incurred as a result of a cancellation or change, such as visas, vaccinations, flights or non-refundable accommodation. This is another reason we strongly recommend comprehensive travel insurance.

5. Travel Documentation and Responsibilities

It is your sole responsibility to ensure that you and all members of your party hold valid travel documents, including:

  • A valid passport with at least six months’ validity beyond the return date of travel
  • All required visas, permits and entry authorisations for each country to be visited
  • Proof of any required vaccinations or health certifications
  • Adequate and valid travel and medical insurance.

 

Arundel Holidays is not liable for any losses, costs or damages incurred as a result of your failure to obtain or maintain appropriate documentation. We recommend checking the entry requirements for all destinations well in advance of travel.

6. Travel Insurance

Arundel Holidays strongly recommends that all clients obtain comprehensive travel insurance before departure. Your policy should cover, at a minimum:

  • Trip cancellation and curtailment
  • Medical expenses, including emergency evacuation and repatriation
  • Personal liability
  • Loss or theft of personal belongings
  • Any activities or adventure experiences included in your itinerary

7. Conduct and Client Obligations

All clients are expected to behave in a respectful and responsible manner throughout their tour. You agree to:

  • Comply with all applicable local laws, customs and regulations of the countries you visit
  • Follow all reasonable instructions given by Arundel Holidays representatives or guides
  • Respect fellow travellers, local communities and the natural environment
  • Refrain from conduct that may cause offence, endanger safety or disrupt the enjoyment of other travellers
  • Comply with all safety briefings provided for activities or excursions

 

Arundel Holidays reserves the right to exclude any client from a tour at any time if, in our reasonable opinion, their behaviour is disruptive, dangerous, illegal or otherwise incompatible with the well-being of other participants or our staff. In such cases, no refund will be given.

8. Liability and Disclaimers

8.1 Limitation of Liability

Arundel Holidays acts as an organiser of tours and travel experiences. While we take every care in selecting our suppliers and partners, we are not the direct provider of all services included in your tour, such as flights, accommodation, transfers and activities. To the fullest extent permitted by law:

  • Our liability for any loss, damage, injury or disappointment is limited to the total cost of the tour booked
  • We are not liable for any indirect, consequential or incidental losses
  • We are not liable for events outside our reasonable control (force majeure).

In addition, Arundel Holidays accepts no responsibility whatsoever for any costs, losses or consequences arising from the following circumstances, which are entirely outside our control:

  • Visa rejection: The Company is not responsible for any visa application that is refused, delayed or cancelled by any government or consular authority, regardless of the reason. Clients are solely responsible for ensuring they meet all visa requirements and for submitting applications on time. No refund of tour costs will be provided on account of a visa rejection.
  • Denied boarding: The Company is not liable for any client being denied boarding by an airline or transport operator for any reason, including but not limited to incomplete documentation, failure to meet carrier requirements, or decisions made at the discretion of the carrier. Any costs incurred as a result of denied boarding are the sole responsibility of the client.
  • Immigration refusal: The Company accepts no liability for any client being refused entry into any country by immigration or border control authorities. It remains the client’s responsibility to ensure they hold the correct and valid documentation required for entry into each destination. Costs arising from deportation, detention or return travel in such circumstances are borne entirely by the client.

In all of the above circumstances, we strongly advise clients to obtain comprehensive travel insurance that specifically covers these eventualities.

8.2 Force Majeure

Arundel Holidays shall not be held liable for any failure to perform, or delay in performance of, our obligations where such failure or delay is caused by circumstances beyond our reasonable control. This includes, without limitation: acts of God, pandemics, war, civil unrest, terrorist acts, government action, industrial disputes, natural disasters or extreme weather.

8.3 Accuracy of Information

While we strive to ensure that all information on our website and marketing materials is accurate, we cannot guarantee that all content is free from errors. Descriptions, photographs and maps are for illustrative purposes only. We reserve the right to correct any errors and will notify you of any material changes that affect your booking.

9. Complaints and Dispute Resolution

If you have a complaint during your tour, please raise it immediately with the relevant Arundel Holidays representative or guide so that we have the opportunity to resolve it quickly.

If your complaint is not resolved to your satisfaction during the tour, you must submit a written complaint to us within 30 days of your return date. We will acknowledge your complaint within 5 business days and aim to provide a full response within 28 days.

Any disputes arising from these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

10. Intellectual Property

All content on the Arundel Holidays website and in our marketing materials, including text, images, logos and itineraries, is the intellectual property of Arundel Holidays and is protected by applicable copyright and trademark laws. You may not reproduce, distribute or use our content for any commercial purpose without our prior written consent.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Sri Lanka. By making a booking, you submit to the exclusive jurisdiction of the Sri Lankan courts for the resolution of any dispute arising under these Terms.
